Data on the controller of personal data

The personal data of the participants in the event will be processed in accordance with the provisions of Regulation EU no. 679/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (“GDPR”).

In order to carry out the event, the personal data of the participants (indicated in this Annex to the Regulation) will be processed by DELIVERY SOLUTIONS S.A. (hereinafter referred to as “Organizer”) exclusive operator of the “Sameday” brand, with its registered office in Bucharest, Globalworth Square Building, 6th floor&7, 6th Floor, 6th Railway Station Street, Sector 2, registered with the Trade Register attached to the Bucharest Tribunal under no. J40/7031/2008, CIF RO 23743772, legally and statutorily represented by Mr. Lucian Baltaru, as CEO.

Categories of personal data processed during the event

During the event, the Operator will collect from the participants the following categories of personal data:

• Name and first name ;
• mobile phone number;
• the information provided in the form

The purpose and legal basis of personal data processing

The personal data of the respondents will be processed by the Data Controller, as participants in the event, directly or through the partners involved in the event, exclusively for the purpose of organizing and conducting it.

The personal data will be processed for the following purposes and according to the grounds described in letters a)-b) below, the legal obligations [Art.6, para. 1, lit. c) of GDPR] and the legitimate interest [art.6, para. 1, lit. f) of the GDPR] of the Organizer:

1. The consent of the respondents regarding the  processing of the personal  data contained in this form
2. Organizing and conducting the event – action to promote the Organizer’s services; designating and validating the cards that will receive giveaways; awarding giveaways; solving any complaints about the organization and development of the event ; for formulating defenses in court / in front of other bodies of jurisdictional activity and / or judicial or administrative procedures; (the organizer’s legitimate interest)

Recipients of personal data

The personal data collected during the event by the Operator will be disclosed to: authorities, in order for the Operator to comply with the obligations imposed by the legislation in force, to external legal consultants of the Operator, to suppliers who provide the Operator with technical assistance regarding the development of this event.

Period of storage of personal data

The personal data of the Participants will be stored for 60 days from the end of the event and will not be used for any purpose other than that provided in this information note.

Upon expiry of the storage period of the personal data, the Data Controller will delete / destroy these data from the means of processing and storage.

Rights of data subjects

In order to ensure a fair and transparent processing, the Operator provides the Participants, during the event, with the following rights:

• the right to withdraw the consent to the processing, at any time, without affecting the legality of the processing carried out on the basis of the consent before its withdrawal;
• the right to request access to personal data;
• the right to request the rectification of personal data;
• the right to request the erasure of personal data
• the right to restrict the processing;
• the right to oppose the processing, unless the legal provisions provide otherwise;
• the right to data portability;
• the right to file a complaint with the National Supervisory Authority for Personal Data Processing.

The participants may exercise their aforementioned rights either by e-mail at the address: [email protected] , or by a written request, dated, signed and addressed to the Operator.

Protection of personal data belonging to children

Since the event may be attended exclusively by individuals aged at least 18 years at the date of the start of the event, no data belonging to persons under the age of 18 will be processed and stored. If the Operator receives personal data belonging to persons under the age of 18, these data will be immediately deleted / destroyed from the Operator’s processing and storage means. If a parent or a holder of parental authority notifies the processing of personal data belonging to persons under the age of 18, the Operator will immediately delete / destroy this data from the means of processing and storage.

Security of personal data

The operator undertakes to implement appropriate technical and organizational measures in order to ensure a level of security appropriate to the personal data belonging to the participants in the event.

Modification of the personal data processing policy

The operator has the right to modify this information note at any time during the event, only if more effective measures are discovered to protect and secure the personal data of the data subjects and without affecting their rights and freedoms.

Other provisions

To the extent that during the event, the Participants disclose personal data belonging to other persons, the participants declare and confirm that they have informed these persons about the use of these data during this event, that they have informed them about this Annex to the Regulation and that they have obtained their consent to the use of the data.
